THIS NOTICE DESCRIBES HOW YOUR MEDICAL or PERSONAL INFORMATION MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice of Privacy Practices is mandated by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). It describes how we may use and disclose your protected health information to carry out treatment, payment or health care operations and for other purposes that are permitted or required by law. It also describes your rights to access and control your protected health information. “Protected health information” is information about you, including demographic information, that may identify you and that relates to your past, present or future physical or mental health or condition; related health care services; or related to the past, present, or future payment for the provision of health care to you.

We are required to abide by the terms of this Notice of Privacy Practices. We may change the terms of our notice at any time. Any such new notice will be effective for all protected health information that we maintain at that time. Upon your request, you may obtain any revised Notice of Privacy Practices by calling us and requesting that a revised copy be sent to you in the mail or asking for one at the time of your next visit. You acknowledge receipt of this notice by accepting Terms & Conditions for using the Services provided by Lose It Nigerian hereby LIN.

  1. Uses and Disclosures of Protected Health Information

USES AND DISCLOSURES OF PROTECTED HEALTH INFORMATION BASED UPON YOUR WRITTEN CONSENT

Your protected health information may be used and disclosed by LIN, Inc. and its affiliates (collectively, “LIN”) and others outside LIN that are involved in your care and treatment for the purpose of providing health care services to you. Your protected health information may also be used and disclosed as necessary to pay health care bills and to otherwise support the operation of LIN.

Set forth below are examples of the types of uses and disclosures of your protected health care information that LIN is permitted to make. These examples are not meant to be exhaustive, but rather to describe for you the types of uses and disclosures that may be made by LIN,

Payment: Your protected health information may be used, as needed, to obtain payment for your health care services. For example, obtaining approval for a hospital stay may require that your relevant protected health information be disclosed to by our health plan to obtain approval for the hospital admission.

Healthcare Operations: We may use or disclose, as needed, your protected health information in order to support the normal business activities of LIN. Examples of these activities include, but are not limited to, quality assessment activities, employee review activities, training, licensing, and conducting or arranging for other business activities.

We also may need to share your protected health information with certain of our “business associates” or other third parties that perform various activities (e.g., billing, coordinating care, transcribing records) for LIN. Whenever an arrangement between LIN and a business associate involves the use or disclosure of your protected health information, we will have in place the legally required safeguards to protect the privacy of your health information.

USES AND DISCLOSURES OF PROTECTED HEALTH INFORMATION BASED UPON YOUR WRITTEN AUTHORIZATION

Other uses and disclosures of your protected health information will be made only with your written authorization, unless otherwise permitted or required by law as described below. You may revoke your authorization, at any time, in writing, except to the extent that LIN has taken an action in reliance on the use or disclosure indicated in the authorization.

OTHER USES AND DISCLOSURES THAT MAY BE MADE AND TO WHICH YOU MAY AGREE OR OBJECT

In the circumstances listed below, you may agree or object to the use or disclosure of the protected health information in the manner described. In the absence of agreement or objection, LIN may, using professional judgment, determine whether the disclosure of health information is in your best interest. If such a determination is made, only the protected health information that is relevant to your health care will be disclosed.

Others Involved in Your Healthcare: Unless you object, we may disclose to a member of your family, a relative, a close friend or any other person you identify, your protected health information that directly relates to that person’s involvement in your health care. If you are unable to agree or object to such a disclosure, we may disclose such information as necessary if we determine that it is in your best interests, based on our professional judgment. We may use or disclose protected health information to notify or assist in notifying a family member, personal representative or any other person that is responsible for your care of your location, general condition or death. Finally, we may use or disclose your protected health information to an authorized public or private entity to assist in disaster relief efforts and to coordinate uses and disclosures to family or other individuals involved in your health care.

Emergencies: In an emergency treatment situation, we may have to use or disclose your protected health information in a context in which consent for the release of information has not already been given. If this happens, LIN will try to obtain your consent to the release of information as soon as reasonably practicable after the delivery of the treatment. If LIN is required to treat you and has attempted to obtain your consent but is unable to obtain your consent, it may still use or disclose your protected health information to treat you.

OTHER PERMITTED AND REQUIRED USES AND DISCLOSURES THAT MAY BE MADE WITHOUT YOUR CONSENT, AUTHORIZATION OR OPPORTUNITY TO OBJECT

There are other circumstances in which we may have to use or disclose your protected health information, even without your consent or authorization. These situations include:

Communication Barriers: If LIN attempts to obtain consent from you but is unable to do so due to substantial communication barriers and LIN determines, using professional judgment, that you would consent to the use or disclosure under the circumstances, we may use and disclose your protected health information.

Disclosure Required By Law: We may use or disclose your protected health information to the extent that the use or disclosure is required by law. The use or disclosure will be made in compliance with the law and will be limited to the relevant requirements of the law. You will be notified, as required by law, of any such uses or disclosures.

Public Health: We may disclose your protected health information for public health activities and purposes to a public health authority that is permitted by law to collect or receive the information. The disclosure will be made for the purpose of controlling disease, injury or disability. We may also disclose your protected health information, if directed by the public health authority, to a government agency that is collaborating with the public health authority.

Communicable Diseases: We may disclose your protected health information, if authorized by law, to a person who may have been exposed to a communicable disease or may otherwise be at risk of contracting or spreading the disease or condition.

Health Oversight: We may disclose protected health information to a health oversight agency for activities authorized by law, such as audits, investigations, and inspections. Oversight agencies seeking this information include government agencies that oversee the health care system, government benefit programs, other government regulatory programs and civil rights laws.

Abuse or Neglect: We may disclose your protected health information to a government authority that is authorized by law to receive reports of child abuse or neglect. In addition, we may disclose your protected health information if we believe that you have been a victim of abuse, neglect or domestic violence to the governmental entity or agency authorized to receive such information. In this case, the disclosure will be made consistent with the requirements of applicable federal and state laws.

Food and Drug Administration: We may disclose your protected health information to a person or company required by the Food and Drug Administration to report adverse events, product defects or problems, biologic product deviations, track products; to enable product recalls; to make repairs or replacements; or to conduct post marketing surveillance, as required.

Legal or Administrative Proceedings or Investigations: We may disclose protected health information in the course of any judicial or administrative proceeding or investigation, in response to an order of a court or administrative tribunal (to the extent such disclosure is expressly authorized), in certain conditions in response to a subpoena, discovery request or other lawful process or request.

Law Enforcement: We may disclose protected health information, so long as applicable legal requirements are met, for law enforcement purposes. These law enforcement purposes include requests: (1) pursuant to legal processes or as otherwise required by law; (2) for limited information for identification and location purposes; (3) pertaining to potential victims of a crime; (4) relating to suspicion that a death has occurred as a result of criminal conduct; (5) in the event that a crime occurs at LIN ; or (6) relating to a medical emergency (not at LIN ) and it is necessary to alert law enforcement regarding a potential crime.

Coroners, Funeral Directors, and Organ Donation: We may disclose protected health information to a coroner or medical examiner for identification purposes, determining cause of death or for the coroner or medical examiner to perform other duties authorized by law. We may also disclose protected health information to a funeral director, as authorized by law, in order to permit the funeral director to carry out his/her duties. We may disclose such information in reasonable anticipation of death. protected health information may be used and disclosed for cadaveric organ, eye or tissue donation purposes.

Threat to Public Safety: Consistent with applicable federal and state laws, we may disclose your protected health information, if we believe that the use or disclosure is necessary to prevent or lessen a serious and imminent threat to the health or safety of a person or the public. We may also disclose protected health information if it is necessary for law enforcement authorities to identify or apprehend an individual.

Research. We may use or disclose your protected health information without your consent or authorization if an Institutional Review Board or Privacy Board approves a waiver of authorization for such disclosure.

Information Not Personally Identifiable.  We may use or disclose your protected health information in ways that do not personally reveal your identity.

  1. Your Rights

Set forth below is a statement of your rights with respect to your protected health information and a brief description of how you may exercise these rights.

You have the right to inspect and copy your protected health information. This means you may inspect and obtain a copy of protected health information about you that is contained in a designated record set for as long as we maintain the protected health information. A “designated record set” contains medical and billing records and any other records that LIN uses regarding your care.

Under federal law, however, you may not inspect or copy the following records: psychotherapy notes; information compiled in reasonable anticipation of, or use in, a civil, criminal, or administrative action or proceeding, and protected health information that is subject to law that prohibits access to protected health information. In some circumstances, you may have a right to review a decision that denies you access to information. Please contact our Privacy Contact if you have questions about access to your health information.

You have the right to request a restriction on the use or disclosure of your protected health information. This means you may ask us not to use or disclose any part of your protected health information for the purposes of treatment, payment or healthcare operations. You may also request that any part of your protected health information not be disclosed to family members or friends who may be involved in your care or for notification purposes as described in this Notice of Privacy Practices. Your request must state the specific restriction requested and to whom you want the restriction to apply. However, LIN is not required to agree to a restriction that you request. If LIN believes it is in your best interest to permit use and disclosure of your protected health information, your protected health information will not be restricted. If LIN does agree to a requested restriction, we may not use or disclose your protected health information in violation of that restriction unless it is needed to provide emergency treatment for you. With this in mind, please discuss any restriction you wish to request in advance with the Privacy Contact listed below.

You have the right to request to receive confidential communications of your protected health information from LIN by alternative means or at an alternative location. We will accommodate reasonable requests. We also may condition this accommodation by asking you for information as to how payment will be handled or specification of an alternative address or other method of contact. We will not request an explanation from you as to the basis for the request. Please make such requests in writing to our Privacy Officer.

You may have the right to have LIN amend your protected health information. This means you may request an amendment of protected health information about you in a designated record set for as long as we maintain this information. In certain cases, we may deny your request for an amendment. If we deny your request for amendment, you have the right to file a statement of disagreement with us and we may prepare a rebuttal to your statement and will provide you with a copy of any such rebuttal. Please contact our Privacy Contact below if you have questions about amending your medical record.

You have the right to receive an accounting of certain disclosures we have made, if any, of your protected health information. This right does not apply to all disclosures; in particular, it does not apply to disclosures for purposes necessary to carry out treatment, payment or healthcare operations as described in this Notice of Privacy Practices. It excludes disclosures we may have made to you, for a facility directory, to family members or friends involved in your care, or for notification purposes. The right to receive this information is subject to additional exceptions, restrictions and limitations. We also are required to notify you following a breach of your health information, if that information is unsecured.

  1. Electronic Communications

However, we warn you that we can make no guarantee that the email will be or will remain encrypted during the data transfer, and that there may be some level of risk that the information in the email could be read by a third party. By communicating with us via email, and, especially by making a request(s) to receive your information via unencrypted email, you acknowledge that you are aware that email is not a secure method of communication, and that you agree to the risks.

  1. Complaints

You may complain to us or to the Secretary of Health and Human Services if you believe your privacy rights have been violated by us. You may file a complaint with us by notifying our Privacy Contact of your complaint. We will not retaliate against you for the filing of such a complaint.

LIN Privacy Policy

 

LIN’s mission is to help as many people as possible live healthier lives through behavior change. We wrote this policy to help you understand what information we collect through our websites, apps, devices, and other products and services, how we use it, and what choices you have about it.

Please note, this policy does not cover data we handle on behalf of other entities. Those practices are covered by our agreements with those entities. Please see those privacy policies for how they handle your data.

How we collect information:

The information we collect depends on how you interact with us, the services you use, and the choices you make. We collect information about you from different sources and in various ways when you use our services, including information you provide directly, information collected automatically, information from third-party data sources, and data we infer or generate from other data.

Information you provide: When you sign up for or use LIN, you share certain information, such as:

  • Common personal information and identifiers: We collect name, username or alias, and contact details such as email address, postal address, and phone number.
  • Demographic data: In some cases, we request that you provide or you may offer age, gender, marital status, and similar demographic details.
  • Payment information: If you make a purchase or other financial transaction, we collect credit card numbers, financial account information, and other payment details.
  • Contents and files: We collect the photos, documents, or other files you upload to LIN; and if you send us email messages or communications, we collect and retain those communications.
  • Sensitive Personal Information:
    • Account access information: We collect information such as a username or account number in combination with a password, security or access code, or other credential that allows access to an account.
    • Contents of communications: We collect the contents of messages you send in chats and message boards in our apps.
    • Health data: We collect and analyze information concerning your health, such as weight, mental state, sleep and exercise habits, and food intake.
    • Sensitive demographic data: We collect information about racial or ethnic origin, religion, or philosophical beliefs that you may provide or we infer throughout the program in order to better support you.

Technical information collected automatically when you use LIN: When you use our website or mobile application, certain internet and electronic network activity information gets created and logged automatically. Here are some of the types of information we collect:

  • Log data: When you use LIN, our servers record information (“log data”), including information that your browser automatically sends whenever you visit a website, or that your mobile app automatically sends when you’re using it. This log data includes your IP address, browser type and settings, and the date and time you used LIN.
  • Geolocation data: Depending on your device and app settings, we collect geolocation data when you use our apps or online services. For example, we may infer your general geographic location (such as city, state, and country) based on your IP address.
  • Cookie data: We and our partners also use cookies, web beacons, mobile analytics and advertising device IDs, and similar technologies. We and our partners use these technologies in websites, apps, and online services to collect personal data (such as the pages you visit, the links you click on, and similar usage information, identifiers, and device information) when you use our services, including personal data about your online activities over time and across different websites, apps, or online services.   • Device information: In addition to log data, we collect information about the device you’re using LIN on, including the type of device, operating system, settings, unique device identifiers, and crash data.
  • Usage data and customization: When you’re on LIN, we use your activity—such as the foods you typically log— to customize your experience. We also automatically log your other activity on our websites, apps, and connected products, including the URL of the website from which you came to our sites, pages you viewed, how long you spent on a page, access times, and other details about your use of and actions on our website.
  • Sensor data: We may also receive data from third party sensors you choose to connect; for example, you can choose to connect your Apple Watch Health App with LIN so we can receive and help you track your step and exercise data.

Information we create or generate: We infer new information from other data we collect, including using automated means to generate information about your likely preferences or other characteristics (“inferences”). For example, we may infer your BMI from your height and weight.

Information collected from third-party services: We also obtain the types of information described above from third parties. These third-party sources include, for example:

  • Third-party partners: Third-party applications and services, including social networks you choose to interact with to connect to our services. What we have access to is dependent on the privacy policies or settings for those accounts.
  • Information our advertisers share with us: We also get information about you and your activity from our advertising partners and other third parties we work with. For example, online advertisers or third parties share information with us to measure, report on, or improve the performance of ads for LIN.
  • Co-branding/marketing partners: Partners with which we offer co-branded services or engage in joint marketing activities.

Our goal is to give you simple and meaningful choices regarding your information. If you have a LIN account, many of these controls are built directly into your settings. For example, you can:

  • Edit information in your profile at any time.
  • Link or unlink your LIN account from other services.
  • Choose whether LIN will be customized for you using your inputs (for example, by adding or removing your food entries or step count).
  • Close your account at any time. When you close your account, we’ll deactivate it and delete your account data. (Please note that there may be legal reasons for us to keep your data, such as if we receive a law enforcement request asking us to preserve data.)

In some jurisdictions, these controls and choices may be enforceable as rights under applicable law.

Access and portability of your information: We can usually share this with you in a portable format within 30 days of you asking us. To request data export, please contact us at [email protected]  using the email address tied to your LIN account.

Correction and deletion of your information: You can log into your profile to update your information or delete your data at any time by closing your account. Please note that there may be legal reasons for us to keep your data, such as if we receive a law enforcement request asking us to preserve data. Object to us processing your information: You can ask us to stop using your information for certain purposes, including when we use your information to send you marketing emails or SMS messages. If you opt-out of receiving marketing messages from us, we may still send you updates about your account, such as when you request reminders from us to log in.

Data sharing or sales: Some privacy laws define “data sharing” or “sales” to include some of the disclosures described in “How and when we share your information” above.

The information we collect may be stored and processed in your country or region, or in any other country where we or our affiliates, subsidiaries, or service providers process data. Currently, we primarily use data centers in Canada. These locations were chosen to operate efficiently and improve our performance.

We take steps to protect your information as described in this policy wherever the data are located, some of which have not been determined by the European Commission to have an adequate level of data protection. When we do so, we use legal mechanisms, including contracts, to help ensure your rights and protections.
